iOS 8 Broke an App

hi all,

curious best thing me in situation is.

while ago purchased app, think around £10, atari. ios 8 has broken app, , can't restore purchases. development team (code mystic) has said know problem , trying resolve it, aren't having luck - on forum.

atari ignoring emails, , apple have sent standard response telling me contact atari, , won't refund amount paid app because it's on 90 day period. moreover, atari still selling app know doesn't work

what's next point of escalation/action take? ideas?

so, atari knowingly selling app won't work? seems need atari either update app, or refund money.
